Texas Lending Laws, A Different Breed
While Texas is a coveted market for a variety of lenders and settlement services providers, it is also a vast state regulated by extremely complex home lending laws. We have worked for over two decades with lenders' groups and our state legislators to allow home equity lending in Texas. A generations-old provision in the Texas Constitution had required strict homestead protections, which excluded home equity lending. Facing ever-changing guidelines, we continue to work with lawmakers to refine the process, making it easier for lenders and borrowers.
It is not just the regulation of home lending in Texas that is unique. With 254 counties, Texas is home to significant variety from county to county when it comes to local customs and record-keeping.
