Texas Lending Laws, A Different Breed
While Texas is a coveted market for a variety of lenders and settlement services
providers, it is also a vast state regulated by extremely complex home lending laws. We
have worked for over two decades with lenders' groups and our state legislators to allow
home equity lending in Texas. A generations-old provision in the Texas Constitution had
required strict homestead protections, which excluded home equity lending. Facing
ever-changing guidelines, we continue to work with lawmakers to refine the process,
making it easier for lenders and borrowers.
